These Terms and Conditions ("Terms") govern your purchase and use of the online courses ("Courses" or "Services") offered by RF Modern Bakery Design ("we," "us," "our") via our website, rfmodernbakerydesign.com (the "Site"). By clicking "I Agree," making a purchase, or accessing our Courses, you ("you," "your," "Student") agree to be bound by these Terms and our Privacy Policy.

• You must be at least 18 years of age to purchase and access our Courses.
• To access certain Courses, you will be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.
• You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any breach of security or unauthorized use of your account.

• Fees: You agree to pay all fees for Courses as listed on the Site. All fees are in U.S. Dollars (USD) and are non-refundable except as explicitly stated in our Refund Policy below.
• Payment Processing: We use third-party payment processors (e.g., Stripe, PayPal). By making a purchase, you agree to their terms and conditions. We do not store your full credit card details on our servers.
• Sales Tax: As a company based in Utah, we are required to collect and remit sales tax on orders delivered to addresses in Utah, as per the Utah State Tax Commission regulations.

• Our IP: All content provided in the Courses, including but not limited to videos, audio, documents, text, graphics, designs, logos, illustrations, course materials, and any other materials ("Course Content") is the intellectual property of RF Modern Bakery Design and its instructors and is protected by copyright, trademark, and other laws.
• Limited License: Upon full payment of the Course fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the Course Content for your personal, non-commercial use only.
• Restrictions: You agree NOT to:
  • Copy, redistribute, resell, republish, transmit, assign, or transfer any Course Content to any third party.
  • Share your login credentials to allow others to access the Course.
  • Record, download, screen capture, or otherwise duplicate the Course Content.
  • Use the Course Content to create a competing business or offer similar courses.
  • Remove any copyright or proprietary notices from the Course Content.

Any violation of these license terms will result in immediate termination of your access to the Course without a refund and may lead to legal action.

Due to the digital and immediately accessible nature of our online Courses, we have a strict no-refund policy.

• Once a Course has been purchased and you have been granted access to the materials, we cannot offer any refunds or credits.
• By completing your purchase, you acknowledge that you have read and agree to this no-refund policy.

You agree to use the Courses and Site lawfully and respectfully. You are solely responsible for your own efforts and results from taking the Course. We do not guarantee any specific business, financial, or creative outcome.

THE COURSES AND ALL RELATED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE COURSES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE FULLEST EXTENT PERMITTED BY UTAH LAW, IN NO EVENT SHALL RF MODERN BAKERY DESIGN, ITS MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Courses;
• Any conduct or content of any third party on the Services;
• Any unauthorized access, use, or alteration of your transmissions or content.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE COURSES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES YOU HAVE ACTUALLY PAID TO US FOR THE SPECIFIC COURSE FROM WHICH THE CLAIM AROSE.

We may suspend or terminate your access to the Courses immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to access and use the Courses will cease immediately.

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.
• Informal Resolution: We strongly encourage you to contact us directly at ordernow@rfmodernbakerydesign.com to resolve any dispute informally before initiating a formal proceeding.
• Venue: Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the state or federal courts located in Salt Lake County, Utah. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and RF Modern Bakery Design regarding the Courses.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date. Your continued use of the Courses after any change constitutes your acceptance of the new Terms.
